What is GST Refund?
A GST refund is the process of claiming back GST
that has been excessively paid, wrongly paid, or accumulated
as eligible Input Tax Credit (ITC).
GST refunds commonly arise in cases involving
exports, LUT-based exports, inverted duty structure,
supplies to SEZs, excess cash ledger balances, and other
eligible refund categories.
In simple terms, if your business has
paid more GST than required or has accumulated
eligible ITC that can be claimed as a refund under GST provisions,
you may be able to recover the amount by filing the appropriate
refund application with accurate documentation and proper
reconciliation.
A GST refund claim should not be prepared merely by checking the
GST portal balance. The refund amount should be
carefully reconciled with GST returns, sales and purchase
invoices, electronic ledgers, GSTR-2B, ITC records,
and other supporting documents.
Proper reconciliation helps ensure that the refund claim is
accurate, well-supported, and less likely to face
objections, deficiency memos, or delays in processing.
Who Can Claim GST Refund in India?
GST refund may be claimed by businesses and taxpayers
who meet the eligibility requirements under the applicable GST
provisions. Common situations where a refund may be
available include:
-
Exports of goods or services
-
LUT-based zero-rated supplies
-
Inverted duty structure
-
Supplies to SEZ units or developers
-
Excess balance in the electronic cash ledger
-
Tax paid wrongly or in excess
-
Accumulation of eligible Input Tax Credit (ITC)
Eligibility depends on the specific refund category
and must be supported by relevant GST records, including
GST returns, invoices, GSTR-2B, payment records,
shipping and export documents, electronic ledgers,
and other applicable supporting documents.
It is important to note that MSME registration alone
does not automatically make a business eligible for a GST
refund. The refund must arise from a valid GST provision
and be supported by proper documentation, accurate
reconciliation, and compliance with the applicable
requirements.
How Does the GST Refund Process Work?
The GST refund process begins with identifying
the correct refund category and verifying the taxpayer's
GST returns, ITC records, invoices, and supporting
documents. The claim is then prepared through proper
reconciliation and filed in Form GST RFD-01,
wherever applicable.
Once the application is filed, an
Application Reference Number (ARN) is generated,
which can be used to track the refund application and its status.
A proper refund process generally involves:
-
Identifying the applicable GST refund category
-
Reviewing GST returns and eligibility
-
Reconciling ITC with GSTR-2B and other records
-
Preparing invoices and supporting documents
-
Filing Form GST RFD-01, wherever applicable
-
Responding to queries, objections, or deficiency memos
-
Tracking the application through the ARN until final processing
An incorrect refund category, data mismatch, incomplete
reconciliation, or missing supporting document can result
in delays, objections, or a deficiency memo.
Proper preparation and documentation can therefore help ensure
a smoother and more efficient refund process.
How Can You Track GST Refund Timeline and Status?
The GST refund status can be tracked using the
Application Reference Number (ARN) generated
after filing the refund application.
The processing timeline may vary depending on the
type of refund, accuracy of documents, GST return
reconciliation, portal processing, and departmental
verification.
The refund process may take longer if there are
mismatches, missing documents, queries, or additional
verification requirements.
Regularly monitoring the GST portal and ARN status
helps businesses stay updated on the progress of their refund
application and take timely action whenever required.
GST Refund on Exporter
GST refund on exports of goods and services refers to the
recovery of eligible GST paid on inputs and input services
used for making such exports.
Under GST law, exports are treated as
zero-rated supplies, meaning no GST is
ultimately charged on the export. However, eligible
Input Tax Credit (ITC) accumulated on inputs
and input services used for exports can be claimed as a refund,
subject to the applicable conditions and provisions of the GST law.
Two Ways to Claim GST Refund on Exports
-
Export with payment of IGST:
The exporter pays IGST on the export and subsequently
claims a refund of the IGST paid.
-
Export under LUT:
The exporter supplies goods or services without payment
of IGST under a Letter of Undertaking (LUT) and claims
a refund of the accumulated eligible ITC.
This comprehensive approach covers
eligibility, the refund process, required documents,
applicable formulas, timelines, and common mistakes,
helping exporters claim their GST refunds efficiently while
avoiding delays, deficiencies, and potential rejection of
refund claims.
What is GST Refund on Export of Goods and Services?
GST refund on exports refers to the recovery of eligible
Input Tax Credit (ITC) accumulated on inputs
and input services used for exported goods or services.
Under the GST law, exports are treated as
zero-rated supplies.
For example, when an exporter purchases raw materials,
packaging materials, or other inputs for manufacturing goods
meant for export, GST may be paid on those purchases. Since
the exported goods are zero-rated, the eligible ITC accumulated
on such purchases can generally be claimed as a
GST refund, subject to prescribed requirements.
Export of Goods
As per Section 2(5) of the IGST Act, 2017,
"export of goods" means taking goods out of India to
a place outside India.
Therefore, where goods are physically moved from India to a
location outside India and the applicable export conditions
are satisfied, the transaction qualifies as an export of
goods under the GST law.
Export of Services
As per Section 2(6) of the IGST Act, 2017,
a supply of services qualifies as an
export of services when the prescribed
conditions are satisfied.
-
Supplier is located in India
-
Recipient is located outside India
-
Place of supply of the services is outside India
-
Payment is received by the supplier in convertible
foreign exchange or Indian rupees wherever permitted under
applicable RBI regulations
-
Supplier and recipient are not merely establishments
of the same person
If all five conditions are satisfied, the supply qualifies as
an Export of Services under GST, subject to
the applicable provisions and restrictions.
Who Can Claim GST Export Refund?
A GST-registered exporter can claim a GST
refund on exports, provided the applicable conditions under
the GST law are satisfied. The exporter must have made a
zero-rated supply and should have the necessary
tax, return, and export documentation in place.
Basic Conditions for Claiming a Refund
-
Goods or services have been exported
outside India, or a qualifying zero-rated supply has
been made to an SEZ unit or developer.
-
Eligible GST has been paid on inputs and/or
input services used in making the zero-rated supply.
-
Applicable GST returns, including GSTR-1 and
GSTR-3B, have been filed and the relevant
transactions are properly reported.
-
Valid export and supporting documents
such as invoices, shipping bills, bills of export,
bank realization documents, or other applicable records
are available.
-
The refund claim is filed
within the prescribed time limit and in
accordance with applicable GST provisions.
Who Can Claim GST Export Refund?
-
Manufacturers exporting goods outside India
-
Merchant exporters making eligible
zero-rated exports
-
Service exporters satisfying the
conditions for export of services
-
Suppliers making zero-rated supplies to SEZ
units or SEZ developers
-
Exporters supplying goods under applicable
concessional tax arrangements, where prescribed
conditions are fulfilled
Types of GST Refund on Export: IGST vs LUT
GST refund on exports can generally be claimed through
two routes: exporting goods or services
with payment of IGST and subsequently claiming a refund,
or exporting under a Letter of Undertaking (LUT)
without payment of IGST and claiming a refund of eligible
accumulated ITC.
Option 1: Export with Payment of IGST — Rule 96
-
Pay IGST at the time of export.
-
The shipping bill is treated as the application
for refund of IGST paid on exported goods,
subject to prescribed conditions.
-
The refund is processed through the customs/ICEGATE
system based on shipping bill, GST return, and
other relevant data matching and validation.
-
This option can be suitable for goods exporters
with sufficient working capital to fund the IGST
payment until the refund is processed.
Option 2: Export Under LUT Without Payment of IGST — Rule 89
-
File the LUT before undertaking exports
without payment of IGST.
-
Export without paying IGST, thereby
avoiding an upfront tax outflow.
-
Claim a refund of eligible accumulated ITC
by filing Form GST RFD-01.
-
This route is generally suitable for
service exporters and businesses seeking to
preserve working capital.
Which Option Should You Choose?
The choice between the IGST payment route and LUT
route depends on factors such as cash flow, type
of export, accumulated ITC, processing timelines, and
compliance requirements.
For many exporters, the LUT route is preferred because
it avoids blocking working capital in IGST, while
the IGST route may be convenient where the exporter has
sufficient liquidity and wants to claim the tax paid on exports.
GST Refund on Inverted Duty Structure
What is Inverted Duty Structure? Simple Explanation
Inverted Duty Structure (IDS) under GST occurs when the GST
rate on your inputs, raw materials, or components is
higher than the GST rate on your finished products.
Under a normal tax structure, the GST rate on inputs is generally
lower than the rate on the final product. In an inverted duty
structure, the situation is reversed:
HIGH GST on inputs + LOW GST on output.
As a result, you pay more GST on your purchases than you collect
on your sales. The excess Input Tax Credit (ITC)
accumulates in your Electronic Credit Ledger, leading to a
blocked working capital position.
Inverted Duty Structure in GST – How It Works
When the GST rate on inputs is higher than the GST
rate on output, Input Tax Credit starts accumulating
in your Electronic Credit Ledger because the available input
tax credit cannot be fully utilised against your output GST
liability.
As a result, the unutilised ITC can continue to build
up every month, locking up valuable working capital.
The concept of an inverted duty structure existed even before
GST, particularly where raw materials attracted higher
import duties than finished goods.
The GST Council has addressed inverted duty
structures through various rate rationalisations over the years.
However, rate differences continue to affect several manufacturing
and other sectors.
Government Solution: GST Refund for Inverted Duty Structure
To provide relief to eligible taxpayers,
Section 54(3) of the CGST Act allows a
registered taxpayer to claim a refund of accumulated ITC
arising due to an inverted duty structure, subject to the
applicable conditions and restrictions.
The refund is calculated based on the prescribed formula under
Rule 89(5) of the CGST Rules and is generally
filed electronically through Form GST RFD-01
on the GST portal.
GST Refund Time Limit for Inverted Duty Structure
This is one of the most critical rules for GST refund
claims and a common reason eligible claims are lost
due to delay.
Under Section 54(1) of the CGST Act, an
application for refund must generally be filed
within two years from the relevant date.
For refunds arising from an inverted duty structure, the
applicable relevant date must be determined in accordance
with the provisions applicable to the claim.
Therefore, taxpayers should carefully track the
refund period, relevant date, and applicable
limitation period to avoid claims becoming
time-barred.
Is Inverted Duty Structure Good or Bad?
For the economy, an Inverted Duty Structure is generally
considered a distortion in the GST rate structure.
It can block working capital, increase compliance requirements,
and put additional financial pressure on businesses.
For manufacturers, IDS can mean that
working capital gets locked up month after month
as excess ITC accumulates in the Electronic Credit Ledger.
While the GST law provides a mechanism to claim a refund,
businesses may not fully utilise it due to lack of awareness,
calculation errors, documentation gaps, or delayed filing.
For businesses affected by IDS, claiming the eligible
GST refund can be an important mechanism for recovering
blocked working capital, subject to applicable
provisions and restrictions.
